Legal
Terms of Service.
The ground rules for using this site, its free tools, and its content — in plain English.
Last updated: [🟡 effective date — confirm at launch]
These Terms of Service (“Terms”) govern your access to and use of hamermarketing.com (the “Site”), operated by Hamer Marketing Group [🟡 confirm the formal legal entity name] (“Hamer,” “we,” “us”). By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. Agreement to these terms
By accessing or using the Site, you confirm that you can form a binding contract and that you agree to these Terms and our Privacy Policy. If you use the Site on behalf of an organization, you represent that you’re authorized to accept these Terms for that organization.
2. Who we are
Hamer Marketing Group provides AI-native fractional CMO/CRO services and related advisory work for B2B SaaS companies. The Site is our public home for that work — case studies, articles, free tools, and a way to get in touch.
3. What this site is
The Site is informational and promotional. Nothing on it is an offer, a contract, or a guarantee of results. Any engagement between you and Hamer is governed by a separate written agreement — booking a call or sending a message does not, by itself, create an engagement or any obligation on either side.
4. Permitted use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site for your own informational and business-evaluation purposes. You may read, share links to, and reasonably quote our content with attribution.
5. Prohibited use
When using the Site, you agree not to:
- Use it for any unlawful purpose or in violation of these Terms;
- Copy, republish, or resell substantial portions of the content as your own;
- Attempt to disrupt, overload, probe, or gain unauthorized access to the Site or its systems;
- Introduce malware, or scrape the Site in a way that harms its operation or violates applicable law;
- Misrepresent your identity or affiliation, or submit false information through our forms.
6. Free tools
The Site offers free tools — including the AI Readiness Checker and the Program Optimizer — that run entirely in your browser and produce a general, automated read based on your answers. They’re provided “as is” for general guidance only, are not a substitute for a real assessment, and their output isn’t a promise of any particular outcome. Some tools may be labeled “coming soon” while we finish building them; those aren’t yet available.
7. No professional advice
Our content and tools provide general information about marketing, revenue, and AI — they are not tailored professional advice and do not create a consulting, advisory, or fiduciary relationship. Don’t rely on the Site as the sole basis for a business decision; for advice specific to your situation, engage us under a written agreement or consult a qualified professional.
8. Intellectual property
The Site and its content — text, design, graphics, the “Hamer” name and marks, and the arrangement of it all — are owned by Hamer or its licensors and protected by applicable law. Except for the limited use above, you may not use our content or branding without our prior written permission. Machine-readable files we publish for interoperability (such as brand-facts.json and llms.txt) may be used as described in those files.
9. Third-party links & services
The Site links to and embeds third-party services (for example, HubSpot for scheduling). We don’t control those services and aren’t responsible for their content, availability, or practices. Your use of them is governed by their own terms and privacy policies.
10. Bookings & inquiries
When you book a session or send us a note, you agree to provide accurate information and understand that we may contact you in reply. As noted above, an inquiry or booking is a conversation — not a binding engagement — until a separate written agreement is signed. How we handle the information you submit is described in our Privacy Policy.
11. Disclaimers
The Site and everything on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Site will be uninterrupted, error-free, or secure, or that its content is complete, current, or accurate. Any performance figures in case studies reflect specific past engagements and are not a prediction of your results.
12. Limitation of liability
To the fullest extent permitted by law, Hamer and its people will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of — or inability to use — the Site or its tools. Where liability cannot be excluded, it is limited to the greatest extent the law allows. [🟡 confirm any liability cap and carve-outs with counsel for your jurisdiction.]
13. Changes to the site and these terms
We may change, suspend, or discontinue any part of the Site at any time, and we may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above; continuing to use the Site after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of [🟡 governing jurisdiction], without regard to conflict-of-laws rules, and any dispute will be handled in the courts located there. [🟡 confirm venue, arbitration, and dispute-resolution terms with counsel.]
